These Terms of Service ("Terms") govern your use of LushAIgent, operated by LushAITech ("we," "our," or "us"). By using our service, you agree to these Terms.

1. Service Description

LushAIgent is an AI-powered assistant accessible via WhatsApp that can perform tasks on your behalf, including interacting with your Google Workspace (Drive, Docs, Sheets, Gmail, Calendar) and performing web research. The service requires a paid subscription.

2. Eligibility

You must be at least 18 years old and have a valid WhatsApp account to use LushAIgent. By signing up, you confirm that you meet these requirements.

3. Account Registration

• You must provide accurate and complete information during registration
• You are responsible for maintaining the security of your account
• You must not share your account or allow unauthorized access
• You must promptly notify us of any unauthorized use of your account

4. Google Workspace Access

When you connect your Google account:

• You grant LushAIgent permission to access the specific Google services you authorize
• We access your data only to execute tasks you request via WhatsApp
• You can revoke access at any time from your dashboard or Google account settings
• You are responsible for the content in your Google Workspace and the tasks you instruct the agent to perform

5. Acceptable Use

You agree not to use LushAIgent to:

• Send spam, bulk messages, or unsolicited communications
• Harass, threaten, or harm any person
• Violate any applicable laws or regulations
• Transmit malware, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' data
• Use the service for any illegal, fraudulent, or deceptive purposes
• Violate WhatsApp's Terms of Service or Business Policy
• Share sensitive information like passwords, credit card numbers, or government IDs through the chat

6. Subscriptions and Payments

• Subscriptions are billed monthly via Razorpay
• Prices are listed on our website and may change with 30 days' notice
• You can cancel your subscription at any time from your dashboard
• Cancellations take effect at the end of the current billing period
• Refunds are handled on a case-by-case basis — contact us at support@lushaigent.ai

7. AI-Generated Content

• LushAIgent uses AI models to generate responses and perform tasks
• AI outputs may not always be accurate or complete — you should review important actions before they are finalized
• We are not responsible for decisions made based on AI-generated information
• The agent will ask for confirmation before taking irreversible actions (e.g., sending emails)

8. Data and Privacy

Your use of LushAIgent is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Service Availability

• We aim for high availability but do not guarantee uninterrupted service
• We may perform maintenance with reasonable notice
• WhatsApp platform availability is outside our control

10. Limitation of Liability

To the maximum extent permitted by law:

• LushAIgent is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the service in the preceding 3 months
• We are not responsible for actions taken by the AI agent on your behalf if you authorized them

11. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time by cancelling your subscription and contacting us. Upon termination, your data will be retained for 30 days and then deleted.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or WhatsApp. Continued use of the service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of India. Any disputes will be resolved in the courts of competent jurisdiction in India.
